ISLAMABAD: The Islamabad High Court (IHC) has sought a detailed response from the Capital Development Authority (CDA) regarding appeals filed by apartment owners and sub-lessees of the One Constitution Avenue project in Islamabad.
A division bench of the IHC heard the case during proceedings held on Monday, where several residents and investors challenged an earlier court decision related to the cancellation of the project’s lease. The court issued notices to the CDA and adjourned the hearing for a later date.
The controversy emerged after the CDA cancelled the lease of the luxury residential and commercial project over alleged non-payment of dues by the developer company. Following the cancellation, concerns were raised about the legal status of apartments and commercial units already sold to third parties.
During the hearing, lawyers representing apartment owners and sub-lessees argued that the residents had purchased properties legally and should not suffer due to disputes between the developer and the CDA. They maintained that hundreds of families, including overseas Pakistanis, had invested significant amounts in the project in good faith.
The petitioners further requested the court to protect the rights of sub-lessees and prevent any coercive action until the matter is fully decided. The legal team also referred to previous judicial precedents emphasizing the protection of third-party interests in property disputes.
